These Terms of Service (“Terms”) are an agreement between you and GD Wizards. By using gdwizards.com or purchasing our services, you agree to these Terms. If you do not agree, please do not use the site.

1. Who we are & what we offer

GD Wizards provides web design, branding, marketing materials, IT and business setup, and small-business automation services.

2. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to purchase our services.

3. Quotes, orders & payment

Prices are shown in U.S. dollars. Payments are processed securely through Stripe. Some projects require a deposit or milestone payments before work begins or is delivered. You are responsible for any applicable taxes. Placing an order or paying a deposit confirms your request; we will confirm the scope of work with you.

4. Refunds & cancellations

Our services are custom work. Deposits and payments for work already performed are generally non-refundable once we have begun. If you need to cancel or have a concern, contact us at [email protected] — we will always try to reach a fair resolution.

5. Your responsibilities

To deliver on time, we rely on you to provide the content, materials, access, and timely feedback we need. Delays in providing these may affect your project timeline.

6. Deliverables & ownership

Upon full payment, the final deliverables we create for you are yours to use. We may display finished work in our portfolio and marketing unless you ask us in writing not to. Third-party assets (such as fonts, stock images, and plugins) remain subject to their own licenses.

Domains & hosting

For most website projects, GD Wizards purchases and registers your web domain and hosting on your behalf and maintains them on our own networks and infrastructure — keeping your site online, secure, and professionally managed. While your website is active with us, the domain and hosting are held and managed by GD Wizards. If you choose to leave, we will work with you in good faith to transfer the domain to you, subject to any outstanding balances and the registrar’s transfer policies. Domain and hosting renewals are billed annually (see Annual Hosting & Domain Renewal) and are included with an active 1-Year Maintenance plan.

Revisions

All design work — logos, branding, websites, and marketing pieces — includes up to three (3) rounds of revisions so we get it right. Additional revision rounds beyond that can be quoted separately.

Website packages & warranty

Our website packages (Micro Site, Starter Website, Advanced Website, and the Starter Package) are as described on our Pricing page; the exact pages, features, and scope of your project are confirmed in your written quote or order. Every website we build includes a 3-month warranty from launch covering bug fixes and minor changes at no additional cost. This warranty does not cover new features, redesigns, third-party breakage, or changes you make yourself — those are handled as new work or under a maintenance plan.

7. No guaranteed results

We take pride in our work, but we cannot guarantee specific business outcomes such as traffic, rankings, sales, or revenue.

8. Acceptable use

You agree not to misuse the site, break any law, infringe others’ rights, or interfere with the site’s security or operation.

9. Third-party services

We use third-party services (such as Stripe, Google, and our web host). Your use of features powered by them may also be subject to their terms and policies. We are not responsible for third-party services.

10. Disclaimers

The site and services are provided “as is” and “as available,” without warranties of any kind, express or implied.

11. Limitation of liability

To the fullest extent permitted by law, GD Wizards will not be liable for indirect, incidental, special, or consequential damages, or loss of profits or data. Where liability cannot be excluded, it is limited to the amount you paid us for the service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless GD Wizards from claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the site or violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be handled in the courts located in California.

14. Changes to these terms

We may update these Terms from time to time. Continued use of the site after changes take effect means you accept the updated Terms.
